Campbell County Smoking PolicyWHEREAS, the Campbell County Commissioners have a duty to protect the health, safety and welfare of the public and employees of Campbell County who utilize County facilities; and WHEREAS, the Occupational Safety and Health Act have regulations governing smoking and ventilation in the workplace, and the County is subject to these regulations; BE IT RESOLVED by the Board of County Commissioners, Campbell County, Wyoming, this 6th day of April, 1993, that: (1) No one can smoke or carry any lighted smoking instrument in a Campbell County facility or at a public meeting in county facilities, except in areas signed as permitted smoking areas. (2) Anyone persisting in smoking contrary to the terms of this policy, after an oral or written request or warning to cease smoking, shall be deemed to be in violation of this policy. (3) In cases of County employees, a violation of this policy shall result in disciplinary action by the appropriate department head and could ultimately result in suspension or termination from employment. (4) For purposes of this policy, the following definitions shall apply: (a) Campbell County Facilities – means any enclosed building or structure that is owned and operated by Campbell County, which includes, but is not limited to, the Campbell County Courthouse, the Recreation Center, the Library, the Detention Center which includes both administrative and jail areas, the Public Health office, the Landfill office, the Road and Bridge, the Animal Control Shelter, the Bicentennial Park Maintenance buildings, the Bell Nob Club House, Campbell County Children's Center, and any other Campbell County facilities not previously listed. (b) Smoke or smoking – means the act of burning any tobacco product, weed filler or plant of any kind in a cigarette, cigar, pipe, water pipe or any other device. (c) Smoking instrument – means any cigarette, cigar, pipe or other smoking device. (5) Smoking shall be permitted in the following facilities only: (a) On the third floor of the Campbell County Courthouse at the southwest end of the building in the enclosed area opposite County Court. (b) Other areas that meet OSHA Regulations and ASHRAE Standards, designed for smoking by the building supervisor, with the approval of the County Commissioners and signed for the purpose of smoking. (6) Smoking shall be prohibited in the following Campbell County facilities: (a) Any stairwell, elevator, hallway, storage room and restroom. (b) The County Commissioners chambers on the first floor of the Courthouse. (c) Any of the public lobby areas. (d) In employee work areas and employee break areas which are shared by smokers and non-smokers. For purposes of this policy, when County vehicles are shared by two or more employees, at the same time, then smoking shall be prohibited unless all the employees and passengers sharing the County vehicles are smokers. (e) Training, meeting and conference rooms. (f) Any areas which are cohabited by smokers and non- smokers. (7) Smoking shall not be permitted and smoking areas shall not be designated, in those county areas where smoking is prohibited by the Fire Chief, State Statute, ordinances, or regulations of the City of Gillette, Campbell County, State of Wyoming, or other applicable laws. Nothing herein shall be interpreted so as to permit smoking where it is otherwise restricted by law. (8) This policy shall become effective April 6, 1993. The building supervisors will be responsible for the implementation of this policy including: (1) Communication of this policy to county employees and the general public. (2) The posting of appropriate signs in the county buildings and leased building space. PASSED AND ADOPTED this 6th day of April, 1993.
