The Campbell County Board of Commissioners met in regular session, Tuesday, December 3, 1996. Chairman Shippy called the meeting to order at 9:00AM and led the Pledge of Allegiance.
Present were David A. Shippy, Les Desavedo, Jan Evans, Commissioners; Susan F. Saunders, County Clerk, Michael A. Maycock, County Attorney; and Bryn N. Stewart, Director of Administrative Services.

Commissioners - Transfer $78,012.45 from 013.6140, legal, to 800.7168, Capital Other Buildings.

Commissioner Desavedo motioned to approve the Amended Budget on the Community Services Black Grant -FY 1995, for the Council of Community Services. Chairman Shippy seconded the motion. The Board was polled:

Commissioner Evans motioned to approve the following bids as presented:
Stewart & Stevenson Power, Inc., in the amount of $19,500 for six new Root Model Snow Plows.
Coleman Equipment Co., in the amount of $23,383 for four Lawton 13' Hopper Spreaders.
Tri State Truck & Equipment, Inc., in the amount of $110,568 for six Ranco 21-42 Bottom Dump Trailers.

Commissioner Desavedo motioned to approve the Agreement between Campbell County and Fox Park Improvement and Service District for the grant in the amount of $4,550, to cover 25% of the costs to develop a Pavement Management Plan for the district. Chairman Shippy seconded the motion. The Board was polled:

Commissioner Evans motioned to approve the Agreement between Campbell County and American Road and Water District, for the grant in the amount of $49,000, to cover 25% of the costs to drill, develop, and connect a new well to the community water system. Chairman Shippy seconded the motion. The Board was polled:

Commissioner Desavedo motioned to approve the partial release of Retainage from the escrow account for Hladky Construction in the amount of $72,000 on the Campbell County Airport Terminal project. Chairman Shippy seconded the motion. The Board was polled:

Chairman Shippy motioned to approve the following Resolution Declaring County Roads “Open Range” Roads:
RESOLUTION DECLARING COUNTY ROADS
“OPEN RANGE” ROADS
WHEREAS, Campbell County, Wyoming, contains numerous County roads, a large portion of which are not enclosed by a fence or are fenced on one side only, and
WHEREAS many of said County roads have become County roads by virtue of §24-1-101 © W.S. 1977, Re-published edition as amended, and were not dedicated to the public by the underlying landowners, and said underlying landowners received no compensation for the taking of their land for a county highway and said landowners continue to pay taxes on the lands underlying said roads, all for the benefit of the traveling public, and
WHEREAS livestock, particularly horses, cattle and sheep frequently cross over said county roads in search of forage, and occasionally pose a hazard for the traveling public; and
WHEREAS the County Commissioners of Campbell County are aware of the general rules of law to the effect that the landowner is not liable for loose stock unless he negligently or knowingly allows them to escape, and
WHEREAS the County Commissioners of Campbell County are aware of the “fence-out doctrine” which has been and continues to be the law in Wyoming, and
WHEREAS the County Commissioners of Campbell County, Wyoming wish to protect from liability, to the extent they are able to do so, those landowners who run domestic livestock in areas wherein County roads are not fenced on both sides, whether dedicated to the public or not, in the event of a collision between a member of the traveling public and domestic livestock, such as horses, cattle or sheep.
NOW, THEREFORE, BE IT RESOLVED BY CAMPBELL COUNTY, WYOMING, as follows:
ALL county roads in Campbell County, Wyoming, whether dedicated to the public or not, and which are not fenced on both sides shall henceforth be also known as Open Range Roads, and landowners who are subject to the rights of the traveling public to use such County roads shall have the right to let their domestic livestock roam at will, over, across and along said County roads with no liability attached thereto other than as established by statutory or common law.

Chairman Shippy motioned to approve the Order Calling for Election on the Country Estates Improvement and Service District and Providing for Notice of Election Date, for the date of election to be February, 18, 1996, and for the election to be a mail ballot election. Commissioner Evans seconded the motion. The Board was polled:

The Commissioner adjourned for lunch at 12:00PM and reconvened into regular session at 1:30PM.
Commissioner Desavedo motioned to approve up to $5,000 from Commissioners Contingency for the Community Vision Program, contingent upon $30,000 in other funds being obtained. Chairman Shippy seconded the motion. The Board was polled:

Commissioner Evans motioned to approve the Residential Lease-Rental Agreement and Deposit Receipt between Campbell County and Ron and Sharon Lane. Chairman Shippy seconded the motion. The Board was polled:
