The Campbell County Board of Commissioners met in regular session Tuesday, March 19, 2002. Chairman Mader called the meeting to order at 9:00 A.M.. Pastor Joel Wright led in prayer and Chairman Mader led the Pledge of Allegiance.



Present were Janet K. Evans, Fred L. Oedekoven, Christopher Knapp, Alan Weakly, Craig G. Mader, Commissioners; Susan F. Saunders, County Clerk; Mike D. Fuller, County Attorney, and Clint Beaver, Director of Administrative Services.

Commissioner Evans moved to approve the Consent Agenda as presented, except for the line item transfer for the Library in the amount of $5,000 from 713.6114, Natural Gas to 713.6851.1/RSS Adult Nonfiction/Reference. Commissioner Oedekoven seconded the motion. The Board was polled:

Commissioner Weakly moved to approve the sale of the surface of the county parcel described as 2.72 acres in the SENW and the NESW of Section 23 of Township 50 North, Range 73 West of the 6th Prime Meridian to Devon Energy Production Company, L.P. for $16,500. Commissioner Knapp seconded the motion. The Board was polled:

All Voted - Aye Carried.



Commissioner Weakly moved to approve an oil and gas lease for the county parcel described as 2.72 acres in the SENW and the NESW of Section 23 of Township 50 North, Range 73 West of the 6th Prime Meridian to Devon Energy Production Company, L.P., for a bonus bid of $400 per acre and a royalty of 18.75%. Commissioner Knapp seconded the motion. The Board was polled:

All Voted - Nay Failed.



Commissioner Weakly moved to approve a shallow gas lease to the depth of 2,500 feet for the county parcel described as 2.72 acres in the SENW and the NESW of Section 23 of Township 50 North, Range 73 West of the 6th Prime Meridian to Devon Energy Production Company, L.P., for a bonus bid of $400 per acre and a royalty of 18.75%. Commissioner Knapp seconded the motion. The Board was polled:

All Voted - Aye Carried.



The Commissioner went into an Executive Session for Potential Litigation at 9:15 AM and reconvened into regular session at 9:30 AM.



Commissioner Knapp moved to ratify its emergency action reinstating the suspended liquor license held by Bryan's Place. Commissioner Evans seconded the motion. The Board was polled:

All Voted - Aye Carried.



Commissioner Weakly moved to instruct the County Attorney to send a letter to all of the County Liquor Establishments notifying them that they have to stay current with their sales tax payments, and that if the County would receive notice that they are not current their license would be suspended and not subject for review to reinstate the license until the next scheduled Board meeting. Commissioner Evans seconded the motion. The Board was polled:

All Voted - Aye Carried.



A Public Hearing was held at 10:00 AM to hear a request from Ken Musser to allow an outdoor billboard to be erected in a C-3 zone along Highway 59 at mile post number 106.



Commissioner Evans moved to approve Case 02.05SUP to grant a Special Use Permit to construct a billboard in the C-3 Business Service District at milepost 106, State Highway 59 for Ken Musser dba Target Sign Company and for the permit to have a 36 month review. Commissioner Oedekoven seconded the motion. The Board was polled:

All Voted - Aye Carried.



Commissioner Oedekoven moved to adopt the resolution for special prosecution, as presented. Commissioner Knapp seconded the motion. The Board was polled:

All Voted - Aye Carried.



Commissioner Weakly moved to approve a grant of $5,000, from the Commissioners' Contingency Account, to the Campbell County Senior Center, to be used toward hiring a Transit Manager. Commissioner Knapp seconded the motion.



Commissioner Weakly moved to table the matter of approving the grant for the Senior Center, until they can discuss the Transit System with the City. Commissioner Evans seconded. The Board was polled:

Commissioner Evans moved to approve the Interagency Cooperative Fire Management Agreement as presented. Commissioner Oedekoven seconded the motion. The Board was polled:

All Voted - Aye Carried.



Commissioner Knapp moved to endorse the application for a Juvenile Accountability Incentive Block Grant for FY 2001. Commissioner Evans seconded the motion. The Board was polled:

All Voted - Aye Carried.



The Commissioner recessed for lunch at 12:10 PM and reconvened at 1:05 PM



Commissioner Evans moved to approve the County participating in the Railroad Crossing improvement on Peaceful Valley Road up to $52,300 with the other two-thirds of the funds coming from the State and the Railroad. Commissioner Oedekoven seconded the motion. The Board was polled:

All Voted - Aye Carried.



Commissioner Weakly moved to approve the Recycling Manager Agreement as amended excluding paragraph six on page four. Commissioner Knapp seconded the motion. The Board was polled:

All Voted - Aye Carried.



The Commissioner went into an Executive Session for Potential Litigation at 1:50 PM and reconvened into regular session at 2:00 PM.



Commissioner Weakly moved to except the Settlement and Release Agreement between Campbell County and Patricia and Michael Deegan as presented. Commissioner Oedekoven seconded the motion. The Board was polled:

All Voted - Aye Carried.



Commissioner Weakly moved to appoint Harry Underwood as a viewer, pursuant to W.S. 24-3-103, to examine the proposed vacation of Rocky Point Drive and report back to the Board. Commissioner Evans seconded the motion. The Board was polled:

All Voted - Aye Carried.



There being no further business to come before the Board of Commissioners the meeting was adjourned at 4:45 P.M.. The next regular scheduled meeting of the Board of Commissioners will be Tuesday, April 2, 2002 at 9:00 A.M. in the chambers of the courthouse.
