The Campbell County Board of Commissioners met in regular session Tuesday, April 6, 2004. Chairman Knapp called the meeting to order at 9:00 A.M. Commissioner Weakly led in prayer and Chairman Knapp led the Pledge of Allegiance.


Present were Alan Weakly, Craig Mader, Roy Edwards, Marilyn Mackey, Chris Knapp, Commissioners; Susan F. Saunders, County Clerk; Carol Seeger, Deputy County Attorney, and Clint Beaver, Chief of Staff.

Commissioner Mader moved to approve all items of the Consent Agenda as presented. Commissioner Mackey seconded the motion.

Commissioner Mackey moved to approve the vouchers as presented. Commissioner Edwards seconded the motion.

            All Voted - Aye                                                                      Carried.


Commissioner Mader moved to adopt the resolution governing fireworks for 2004, as presented. Commissioner Weakly seconded the motion.

            All Voted - Aye                                                                      Carried.


Commissioner Mader moved to adopt the resolution regulating the storage of fireworks for 2004, as presented. Commissioner Weakly seconded the motion.

            All Voted - Aye                                                                      Carried.


Commissioner Mackey moved to approve the grant application to the Federal Aviation Administration for funding the construction of an Airport Rescue Fire Fighting and Snow Removal Equipment facility, as presented. Commissioner Edwards seconded the motion.

            All Voted - Aye                                                                      Carried.


Commissioner Weakly moved to adopt the resolution proclaiming April 19-23, 2004, as “Week of the Young Child,” as presented. Commissioner Mader seconded the motion.

            All Voted - Aye                                                                      Carried.


A Public Hearing was held at 10:30 AM for the purpose of hearing the proposed boundary changes to District 03-01 and District 13-01. Buffalo Cut Across Road from the Sheridan-Campbell County Line east to the intersection of Buffalo Cut Across and Saunders Road, thence along Saunders Road to the intersection of Highway 50. Those areas north of this line will be in District 03-01, and those areas south of this line will be in District 13-01.


Commissioner Mader moved to alter the Election Precinct Boundaries for Districts 03-01 and 13-01, as presented. Commissioner Weakly seconded the motion.

            All Voted - Aye                                                                      Carried.


A Public Hearing was held at 10:45 AM for the purpose of hearing a request to resubdivide Lots 6 and 7, Block 6, Antelope Valley, Phase II.


Commissioner Mackey moved to approve the final plat for the resubdivision of Lots 6 and 7, Block 6 of the Antelope Valley, Phase II, as presented. Commissioner Edwards seconded the motion.

            All Voted - Aye                                                                      Carried.


A Public Hearing was held at 11:00 AM for the purpose of hearing a variance for a large private garage to be built at Butler Mobile Home Park, Lot 1, 2044 Highway 14-16.


Commissioner Mader moved to grant a variance from Section 12(b)(1) of the County Zoning Regulations to Barbara Hennings, owner of Lot 1, Butler Mobile Home Park, to allow construction of a private garage, provided that the garage not be used for commercial purposes. Commissioner Weakly seconded the motion

            All Voted - Aye                                                                      Carried.

 

Commissioner Weakly moved to propose for public comment, amendments to Chapter 6, Rules Governing the Subdivision of Land, as presented. Commissioner Edwards seconded the motion.

            All Voted - Aye                                                                      Carried.


Commissioner Edwards moved to approve the final plat for the resubdivision of Lots 5A, 5B, 5C, and 6 Wind Dancer II, as presented. Commissioner Mackey seconded the motion.

            All Voted - Aye                                                                      Carried.


Commissioner Edwards moved to approve the final plat for Creekside Subdivision, as presented. Commissioner Mackey seconded the motion.

            All Voted - Aye                                                                      Carried.

 

The Board recessed for lunch at 11:40 AM and reconvened into regular session at 1:30 PM.


Commissioner Mackey moved to appoint John F. Simon, Brian P. Hopkins, Melissa S. Hopkins, Kodi L. Majors, and Bart Majors, as directors of the High Plains Water & Sewer District, pursuant to W.S. 22-29-202 as requested. Commissioner Edwards seconded the motion.

            All Voted - Aye                                                                      Carried.


Commissioner Weakly moved to approve the Alternate Proposal III as the official equipment list for Homeland Security Grants I and II, as requested. Commissioner Edwards seconded the motion.

            All Voted - Aye                                                                      Carried.

 

Commissioner Mackey moved to approve payment of the invoice from Collins Communications, Inc. in the amount of $4,620.00 from the operating contingency account, as presented. Commissioner Edwards seconded the motion.

            All Voted - Aye                                                                      Carried.


Commissioner Mackey moved to grant permission to the City of Gillette Streets Division for free dumping at the Campbell County Landfill for city trucks for the period of April 26 to May 7, Monday through Friday for their Spring Cleaning project. Commissioner Weakly seconded the motion.

            All Voted - Aye                                                                      Carried.

 

Commissioner Weakly moved to award a District Support Grant to High Country Improvement and Service District in the amount of $1,250.00, to improve the District’s roads. Commissioner Mackey seconded the motion.

            All Voted - Aye                                                                      Carried.

 

Commissioner Mackey moved to approve the Right of Way Agreements for Force Road, as presented. Commissioner Edwards seconded the motion.

            All Voted - Aye                                                                      Carried.

 

Commissioner Weakly moved to table the determination to vacate or not vacate a portion of Gold Road at this time with a date to be set in the future. Commissioner Edwards seconded the motion.

            All Voted - Aye                                                                      Carried.


Commissioner Mader moved that the Board find that Neil and Yvette Morsett do not have legally enforceable access to their property as alleged in their petition, and appoint Bill Carson, Allen Mooney and Lester Clements, as viewers and appraisers to perform the duties specified in W.S. 24-9-101(h) and(j), and to report their recommendations to the Board pursuant to W.S. 24-9-103. Commissioner Weakly seconded the motion.

            All Voted - Aye                                                                      Carried.


Commissioner Weakly moved that a temporary access be provided to Neil and Yvette Morsett to their property until the viewers report and action is taken on the viewers report, the access being identified as the east access alternative. Commissioner Mader seconded the motion.

            All Voted - Aye                                                                      Carried.

 

Commissioner Mader moved to direct that the viewers and appraisers meet on May 5, 2004, to move the process forward. Commissioner Edwards seconded the motion.

            All Voted - Aye                                                                      Carried.


There being no further business to come before the Board of Commissioners the meeting was adjourned at 2:35 P.M. The next regular meeting of the Board of Commissioners will be Tuesday, April 20, 2004 at 9:00 A.M. in the Commissioners chambers in the courthouse.
