SPECIAL MEETING

The Campbell County Board of Commissioners met in Special Session Monday, August 2, 2004. Chairman Knapp called the meeting to order at 11:40 AM.

Present were Marilyn Mackey, Roy Edwards, Alan Weakly, Craig Mader, Chris Knapp, Commissioners; Susan F. Saunders, County Clerk, and Clint Beaver, Chief of Staff.

The purpose of the Special Meeting was to amend the Oder Levying Requisite Taxes for Tax Year 2004.

Commissioner Mackey moved to adopt the amended Order Levying Requisite Taxes for Tax Year 2004, as presented. Commissioner Edwards seconded the motion.

            All Voted - Aye                                                                      Carried.

AMENDED ORDER LEVYING REQUISITE TAXES

 TAX YEAR 2004

            WHEREAS, on July 20, 2004, this Board adopted a County budget for the 2004-2005 fiscal year ending June 30, 2005; and

            WHEREAS, after deducting all other cash and estimated revenue, it is necessary for the balance to be raised by general taxation; and

            WHEREAS, W.S. 39-13-102(g) provides that the Board of County Commissioners shall levy the requisite taxes for the year on or before the first Monday of August; and

            WHEREAS, W.S. 11-5-111 provides that the Board of County Commissioners shall levy a tax for the Weed and Pest Control Fund; and

            WHEREAS, W.S. 21-13-201(a) provides that the Board of County Commissioners shall levy a tax of six (6) mills for the support and maintenance of the public schools; and

            WHEREAS, W.S. 35-2-414(b) provides that the Board of County Commissioners shall levy a tax for special hospital districts; and

            WHEREAS, W.S. 35-8-314(b) provides that the Board of County Commissioners shall levy a tax for special cemetery districts;

            THEREFORE, IT IS HEREBY ORDERED that, pursuant to the above-cited statutory authorities, property taxes are levied to raise the following amounts for the Tax Year 2004:

Severability: If any provision of this resolution is held or deemed inoperative or unenforceable, the same shall not affect any other provision or directive which can be independently construed.
