Open Burning Restrictions

Due to a potentially severe to extreme fire situation, the Campbell County Fire Department Division Chief requested the Commissioners adopt a resolution restricting open burning.

After a wet spring, heavy vegetation combined with higher temperature and decreased humidity pose a potentially severe to extreme fire situation. Resolution 1980 imposes restrictions on open burning activities. The resolution will take effect starting at 12:01 a.m. on Wednesday, August 8th and will remain in place until weather conditions have sufficiently changed to a reduced risk of wildland fires.

The resolution puts in place a partial closure of outdoor fires in unimproved areas, defined as cropland, agricultural land and undeveloped land which predominately remains in its natural forested or range condition. The exceptions to the restrictions include:

  • Trash or refuse fires between the hours of 6:00 p.m. and 8:00 a.m., inside containers provided with spark arrester and located within a cleared area ten feet in radius, are permitted;
  • Charcoal fire within enclosed grills are permitted;
  • Use of acetylene cutting torches or electric arc welder in cleared areas ten feet in radius are permitted;
  • Propane or open fire branding activities in cleared areas ten feet in radius are permitted;
  • Use of chainsaws, provided that the chainsaws have spark arresters properly installed and functioning;
  • Federal, State, local fire or law enforcement officers participating in fire,emergency, and law enforcement activities
  • Public or privately sponsored fireworks display which is coordinated with the Campbell County Fire Warden or his designee.

Failure to comply with this resolution may be punishable by up to a $100.00 fine and up to 30 days imprisonment, or both together along with restitution for the cost of fire suppression and damages as a result of the violation.
